This website is operated by Shore Optical Pty Ltd, trading as Shore Goggles ("Shore Goggles", "we", "us" or "our").

These Terms & Conditions govern access to our website and the purchase of our products by Australian and international customers.

By placing an order, you agree to these Terms & Conditions. All transactions remain subject to applicable consumer protection laws.

3. Website Use

You must not use our website for unlawful or fraudulent purposes, infringe intellectual property rights, interfere with website security or attempt unauthorised access.

We may restrict access where reasonably necessary to protect our business, customers or systems.

4. Products and Availability

We take reasonable care to ensure product descriptions, specifications, images, pricing and availability are accurate.

Colours and finishes may vary slightly due to lighting and screen settings. Products remain subject to availability.

We may update product information and correct genuine errors, provided existing contractual and statutory rights are respected.

5. Product Safety and Intended Use

Shore Goggles supplies specialist sporting eyewear and accessories designed for their stated applications.

Products must be used according to their intended purpose and any supplied safety and care instructions. Customers should inspect eyewear before use and discontinue use if lenses, straps or components become damaged or compromised.

No sporting eyewear can eliminate all risks of injury, impact or flying debris.

Customers participating in regulated sporting activities should ensure their equipment complies with applicable sporting rules.

Performance and protection claims apply only to the specifications and testing expressly stated for each product.

Nothing in this section excludes liability for defective products, misleading representations or obligations imposed by applicable law.

6. Pricing and Payment

Unless otherwise stated, prices are displayed in Australian Dollars (AUD) and include Australian GST where applicable.

Shipping charges and taxes collected by Shore Goggles will be disclosed at checkout.

International customers may incur currency conversion fees, customs duties, import taxes or other destination charges, unless expressly included in the purchase price.

Payments are processed through the available checkout providers. We may undertake reasonable fraud-prevention checks.

7. Orders and Acceptance

Placing an order constitutes an offer to purchase.

An automated order acknowledgement confirms receipt but does not necessarily constitute acceptance. Orders are accepted upon express confirmation or dispatch, whichever occurs first.

We may decline orders before acceptance due to stock unavailability, payment failure, genuine pricing errors or suspected fraud.

Where payment has been received for an order we cannot fulfill, we will provide an appropriate refund or other remedy required by law.

8. Shipping and Delivery

Our Shipping Policy forms part of these Terms & Conditions.

Delivery estimates are indicative unless otherwise agreed or required by law. Delays may occur due to carriers, customs, weather or circumstances beyond our reasonable control.

Customers must provide accurate delivery information.

Risk of accidental loss or damage passes to the customer upon delivery to the customer or an authorised recipient, or otherwise as required by applicable law.

Lost, damaged or undelivered orders will be investigated and resolved in accordance with applicable consumer rights.

9. International Orders

International orders may be subject to destination-country import requirements, customs duties, taxes and processing fees.

Unless otherwise stated at checkout, customers are responsible for applicable import charges that Shore Goggles is not legally required to collect or pay.

Customs delays, refused deliveries and returned shipments will be managed in accordance with applicable law and our Shipping Policy.

We may restrict delivery to destinations where lawful supply or product compliance cannot reasonably be established.

Mandatory consumer rights in the destination country remain unaffected.

10. Returns, Refunds and Consumer Rights

Our Returns & Refunds Policy forms part of these Terms & Conditions.

For Australian customers, our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

International customers retain any mandatory consumer guarantees, cancellation rights, withdrawal rights and remedies applicable in their jurisdiction.

No provision in these Terms limits rights that cannot lawfully be excluded.

11. Liability

To the maximum extent permitted by law, Shore Goggles is not liable for losses for which it is not legally responsible, including losses arising solely from circumstances beyond our reasonable control.

We do not guarantee that sporting eyewear will prevent injury or eliminate risks associated with sporting activities.

Nothing in these Terms excludes or limits liability for defective products, personal injury, negligence, fraud, breach of consumer guarantees or any other liability to the extent that exclusion or limitation is prohibited by law.

Any permitted limitation of liability applies only to the extent lawful and enforceable.

12. Intellectual Property

All website content, branding, trademarks, logos, product images, designs, text and graphics are owned by Shore Optical Pty Ltd or used under licence.

All rights are reserved.

Unauthorised commercial reproduction, distribution, modification or use of our intellectual property is prohibited except where permitted by law or authorised in writing.

Purchasing a product does not transfer intellectual property rights.

13. Reviews and Customer Content

Customers submitting reviews, images or other content must have the right to provide that material.

Content submitted specifically for publication may be displayed by Shore Goggles for the disclosed purpose, subject to applicable privacy and intellectual property laws.

We may remove unlawful, fraudulent or inappropriate content but will not manipulate reviews in a misleading manner.

14. Promotions

Discounts, promotional offers, competitions and giveaways may be subject to separate terms, eligibility requirements and expiry dates.

We may reject fraudulent promotional activity where legally permitted.

All promotions remain subject to applicable consumer and promotional laws.

Disputes are subject to the non-exclusive jurisdiction of New South Wales courts, without restricting any consumer's right to pursue remedies elsewhere where legally permitted.

If any provision is found invalid or unenforceable, the remaining provisions continue to operate to the extent permitted by law.
